Gio Host owns all editorial content and graphics on this site. Gio Host provides web services to subscribers worldwide, and all customers must adhere to the following Terms and Conditions of Service. The terms of service outlined below aim to deliver the highest level of service possible. This Gio Host Terms of Service agreement (hereinafter referred to as the "TOS") establishes the terms and conditions under which Gio Host's Services (hereinafter referred to as the "Services") will be provided to you upon your registration. You confirm that you are at least 18 years old. The TOS clearly defines what is permitted and prohibited regarding the Services. This TOS is not exhaustive, and Gio Host reserves the right to modify it at any time, with notice published on our website. No employee of Gio Host, whether through verbal or written communication, or any content on the Gio Host website, will take precedence over the TOS. By registering for and using any of Gio Host's Services, you agree to all terms and conditions of the TOS, including any future changes.

Customers are responsible for their clients if they resell or represent the Services for which they are paying. Only the paying Customer is recognized by Gio Host, not their clients. Violations of the TOS or any other actions deemed inappropriate by Gio Host may result in the suspension or termination of the Customer's Services.

Service Delivery Time

We provide our services instantly by sending an email to your registered email address and granting access to your Gio Host dashboard. The entire process is automated. However, if there is a failure in automation for any reason, service delivery may take up to 24 hours.

New Accounts

Your account will be set up once we have received payment and screened the order(s) for fraud through our team and/or our payment partners. You must provide an email address that is not associated with the domain(s) under which you are registering. If there are any issues regarding abuse or if we need to contact you, we will use the primary email address on file. It is essential to keep this email address up to date at all times. You must ensure that the contact information for your domain account and your actual domain name(s) are valid and current if you have a domain name registered with Gio Host. Gio Host is not responsible for any lapsed registration caused by outdated contact information linked to the domain. If you need to verify or change this information, please go to your client section and make the necessary updates yourself. Providing fraudulent contact information of any kind may result in account termination. Within three days of establishing your account with Gio Host, you will be required to present government-issued identification (Passport/National ID/Driving License, etc.) and proof of address (Utility Bill) for any service purchased from Gio Host. Failure to meet these requirements may result in your order being flagged as fraudulent and subsequently refused. New account setup may also be delayed due to unforeseen challenges with various mail servers or connection issues between your ISP and Gio Host's operational office.

Transfers

Our migration team will do everything possible to assist you in moving your site to us. However, transfers are provided as a best-effort service, and we cannot guarantee availability, feasibility, or the time required for an account transfer. Each hosting provider has different setups, and some platforms store data in incompatible or proprietary formats, making the migration of certain or all account data exceedingly difficult or impossible. While we will strive to assist you in transferring data from a previous host, there may be situations where this is not feasible. Free transfer services are available for three (3) days after you sign up.

Satisfaction Guaranteed

Only the Web Hosting service is covered by a 7-day satisfaction guarantee. If you are dissatisfied with our Web Hosting services for any reason during the first 7 days, you may request termination of your services in writing via email or through our cancellation form. Upon approval, you will receive a full refund*. You must also provide a specific explanation for your cancellation, as this is required for all cancellation requests, regardless of the time frame. We are the sole arbitrators of whether your reason is valid and if both parties took reasonable steps to address any issues leading to the cancellation. If the customer has violated the terms of the agreement, this may affect eligibility for a refund.

Payments

When you subscribe to our services, you are signing up for a prepaid service. All services (including domain registration, web hosting, SSL, etc.) are subject to a 5% VAT, or a combination of 5% VAT and 2% sales tax for web development services. Past-due invoices can be paid online using bKash or PayPal, as well as through bank transfer or walk-in payments at our operation office. All online payments (except those made through offline methods) are subject to a payment gateway fee, which will be added automatically when you select payment options in your Clients Area > Invoice.

Renewal notices will be sent multiple times via email from 30 to 1 day before the renewal date. The only accepted payment methods at our operation office are bKash, PayPal, Bank Transfer, and Walk-in Payment. If your yearly charge is declined and we cannot reach you, late fees will apply to authorize your account. Any questions regarding payments should be directed to our support forum. The following steps will be taken if an account (shared/reseller/VPS/Dedicated/Email Server/Spam Filtering/File Hosting) has a past-due invoice:

  1. Day 1 – No Action Take
  2. Day 2 – Accounts are suspended
  3. Day 7 – Late Fee Added
  4. Day 15 – Accounts will be terminated
Cancellations

To cancel your services, you must write to our sales team or request cancellation from your Clients Area.

Overage Charges

To meet our customers' needs, our service plans are designed to accommodate most usage scenarios. However, your consumption may vary and require additional resources, particularly in terms of storage and traffic. If your account requires more resources, we will not automatically charge your card. It is essential to keep your cPanel email address updated so that you can receive notifications when your account reaches specific limits set by our system. At that point, you can contact us to upgrade your account's transfer quota. If your resource allocations are exceeded and you do not reach out to us, the system will suspend your site.

Refunds/Account Termination

If Gio Host fails to provide the agreed-upon services for any reason, a prorated refund will be granted. However, if we are forced to suspend or terminate your services due to a violation of our stated policies, no refunds will be issued. Upon requesting account cancellation, your account will be suspended immediately after your service has been canceled and will be deleted within 30 days. If your account is suspended for any other reason and remains suspended for more than 10 days, it will also be deleted. If you have multiple accounts with Gio Host, we reserve the right to suspend all accounts if one or more accounts are past due until all payments are made.

If you are found to be in breach of our terms and conditions, no refund will be provided. Additionally, refunds are only available once for any product; if you use our service a second time, you will not qualify for a refund.

Content

All Gio Host services must be used for legitimate purposes only. Any information, data, or content sent, stored, or presented in violation of any local laws in Bangladesh is strictly prohibited. This includes copyrighted information, material deemed threatening or obscene, content that threatens national security, and material protected by trade secrets or other laws. The subscriber agrees to indemnify and hold Gio Host harmless from any claims arising from the subscriber's use of Gio Host services that may harm the subscriber or others.

While we support free expression, any content (written, visual, or implied) that falls into categories such as creed or religious beliefs; vulgarity or offensive language directed at anyone other than oneself; or violent or malicious content will not be tolerated. We encourage you to manage your content responsibly and take charge of what your website offers. Please note that we do not have the resources or capacity to monitor and manage our servers continuously.

Prohibited Content

The following content or links are strictly forbidden on Gio Host services (but are not limited to):

  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Software/Warez
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad Services (commercial banner ad rotation)
  • File Dump/Mirror Scripts (similar to Rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (including FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi schemes, MLM/Pyramid schemes)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs

Gio Host reserves the right to take appropriate action against any accounts found to be in violation of these prohibitions, which may include suspension or termination of services.

Prohibited Content on Dedicated Servers and Colocation Services

On all Gio Host dedicated servers and colocation services, the following content is strictly prohibited:

  • IRCD (IRC servers)
  • IRC Scripts/Bots
  • Pirated Software/Warez
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Escrow Services
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (including FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi schemes, MLM/Pyramid schemes)
  • Sale of any controlled substance without prior proof of appropriate permit(s
  • Prime Banks Programs
  • Lottery Sites
  • Hateful/Racist/Harassment-oriented sites
  • Hacker-focused sites/archives/programs
  • Sites promoting illegal activities

Storage and Backup Policies

It is not permissible to use any Gio Host shared web hosting account as a backup or storage device (files/database dumps/file sharing media, etc.). Shared web hosting accounts are intended solely for the storage of websites and not for remote file storage. If we discover that a shared web hosting account is being used for such purposes, it will be considered a violation of our Terms of Service, and the account will be suspended or terminated immediately.

VPS and Dedicated Server plans do not have limitations regarding backup/storage. However, any website that uses more than 70% of its total disk space to store files—either in terms of overall size or number of files—will be flagged for unusual usage. You will be notified if we find that any files are unlawful or harmful in any manner. If you do not intend to harm our server or others with the files you maintain, you have nothing to worry about.

Monitoring and Access Policies

Gio Host services, including all related equipment, networks, and network devices, are only available to customers who have been granted permission. Our systems may be monitored for lawful reasons such as ensuring authorized use, system administration, protecting against unauthorized access, and verifying security protocols and operational security. Information may be viewed, recorded, copied, and used for permitted purposes during monitoring. By using Gio Host systems, you agree to be monitored for these purposes.

Any account found connecting to a third-party network or system without the third party's permission will be suspended. Accessing networks or systems not under your direct control requires clear written agreement from the third party. Gio Host may request documentation to confirm that access to a third-party network or system is authorized at its discretion. We reserve the right to deny service to anyone for any reason.

Content Removal and Abuse Reporting

Any material that we deem obscene, threatening, illegal, or violating our terms of service may be removed (or otherwise disabled) from our servers with or without notice. If you do not respond to our abuse department's email within 48 hours, your services may be suspended or terminated. All abuse issues must be reported via trouble ticket or email, and a response will be provided within 48 hours.

Child Protection Policy

Potential harm to children—including but not limited to child pornography or content believed to be child pornography—is strictly prohibited. Any site found hosting or connecting to child pornography will be suspended immediately and without warning. For resellers, we will suspend the affected site and contact you so that you can cancel the account. We will continue to monitor your activity; multiple infractions of this nature may result in immediate termination of your account. For direct customers, your services will be canceled with or without notice.

Opt-in Email Marketing

If you choose to engage in marketing your site and/or services via email, please adhere to the following guidelines. The only permitted form of email marketing is opt-in, which means that individuals must provide their email addresses specifically requesting to be added to your email list for information about your site and/or services. If we find your account sending emails to individuals who did not authorize such communication, this will result in suspension or termination of your site. Please note that joining an opt-in email list does not guarantee the legitimacy of that list. We recommend contacting us before taking any steps to avoid falling victim to spam from second or third-party lists.

Zero Tolerance Spam Policy

Unsolicited commercial email (UCE) and unsolicited bulk email (UBE), commonly known as spam, are strictly prohibited at Gio Host. Spam is defined as follows: An electronic message is considered spam if it meets the following criteria:

  1. The recipient's identity and context are irrelevant because the message is equally applicable to many other potential recipients;
  2. The recipient has not verifiably granted explicit, deliberate, and revocable permission for the message to be sent;
  3. The transmission and reception of the message appear to benefit the sender disproportionately.

If you send an email to someone who has not specifically requested to receive it, you will be charged with UCE/UBE abuse, regardless of where the email was sent from. Any Gio Host customer found engaging in this conduct will have their service suspended if abuse is confirmed. Spam not only strains server resources, reducing uptime and performance but also puts the server at risk of being blacklisted.

Email Sending Guidelines to subscribers

This Domain Policy outlines the terms and conditions governing domain name sales, offers, discounts, transfers, and pricing at Gio Host. By purchasing a domain name from Gio Host, you agree to adhere to the following policies:

Domain Transfer Restrictions
  • Domains sold under special offers or with discounts are subject to a two-year transfer restriction. This means that these domains cannot be transferred to another registrar within two years (24 months) from the date of purchase
  • This restriction is in place to prevent abuse of promotional pricing and to protect Gio Host's investment in offering discounted domain names
  • After the initial two-year period, domain transfers will be subject to standard ICANN transfer policies and procedures
Domain Pricing
  • Domain prices are subject to change based on fluctuations in international currency exchange rates, particularly in relation to the US dollar
  • Gio Host reserves the right to adjust domain pricing at any time to reflect current market conditions and exchange rates
  • Customers will be charged the price displayed at the time of purchase, but renewal prices may vary
Discount and Offer Cancellation
  • Gio Host reserves the right to modify or cancel domain discount pricing and special offers at any time without prior notice
  • If a discount is cancelled after a domain is purchased but before its renewal date, the renewal price will be based on the standard, non-discounted rate
  • Gio Host is not liable for any losses or damages resulting from the cancellation of a domain discount or special offer.
ICANN Regulations and Transfer Policy
  • Gio Host adheres to the transfer policies set forth by the Internet Corporation for Assigned Names and Numbers (ICANN)
  • According to ICANN regulations, a domain is often locked for 60 days after initial registration or after a change of registrant contact information
  • This 60-day lock may prevent domain transfers within that period2. Some registrars may offer an opt-out option for the 60-day lock after contact information changes, but this is not guaranteed
  • To transfer a domain, you typically need an AuthInfo code (also called an Authorization Code, AuthInfo code, Auth-Info Code, or transfer code) from the current registrar
Reasons for Transfer Failure

A registrar may deny a transfer request under certain circumstances:

  • Evidence of fraud
  • Reasonable dispute over the identity of the person authorizing the transfer
  • Domain name is on hold due to payment owed
  • Domain name is in "Lock" status23. (You must remove the lock status via your current registrar2).
  • Domain name is within 60 days of initial registration
  • Domain name is within 60 days of a previous transfer
  • Domain name is the subject of a legal proceeding
Domain Name Holder Responsibilities
  • The domain name holder is responsible for providing accurate and up-to-date contact information.
  • Incorrect contact information may cause transfer failures.
  • It is the domain name holder's responsibility to ensure they have access to the administrative contact information to authorize domain transfers.
Domain Locking
  • Domains can be locked to prevent unauthorized transfers
  • You must remove any domain locks before initiating a transfer
Additional Information
  • Domain transfers can take between 3 to 10 business days to complete
  • Gio Host may deny a transfer request if the domain name is subject to a 60-day Change of Registrant lock

If your site will be sending out mailings to subscribers, you must adhere to the following checklist:

  • Transparency: Do not attempt to conceal, forge, or misrepresent the sender of the email or the site from which the email is sent. Bulk mailings must clearly explain how the recipients' email addresses were obtained and the frequency of emails sent.
  • Unsubscribe Procedures: Unsubscribe options should be easy and evident in bulk mailings. This should include a working link to a one-click unsubscribe system, although providing a physical mailing address is also acceptable.
  • Contact Information: All subscription-based emails must include legitimate, non-electronic contact information for the sending organization, such as a phone number or physical mailing address.
  • Solicited Emails: All bulk emails must be solicited, meaning that the sender has an established and verifiable relationship with the email recipient, who has not requested removal from the mailing list. Documentation of this relationship must be available upon request.
  • Unsolicited Bulk Email (UBE): Sending unsolicited emails to a large number of people is strictly forbidden on Gio Host servers. It is also prohibited to transmit UBE from another service provider while advertising a website, email address, or any other resource hosted on Gio Host servers. Accounts or services may not be used to solicit customers from or collect replies to messages that violate this policy.
  • Confirmed Mailing Lists: It is illegal to add email addresses to any mailing list without clear and verifiable authorization from the owner. Customers must use closed-loop mailing lists, retaining each address owner's subscription confirmation message for the lifetime of the mailing list. Purchasing email address lists from third parties for use in any Gio Host-hosted website is strictly prohibited.
  • Spamhaus Compliance: Operating an account on behalf of or in connection with persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database is not permitted.

By following these guidelines, you can ensure compliance with our policies and maintain a positive reputation for your email marketing efforts.

Script Usage Policy

Gio Host offers web hosting accounts that allow the execution of CGI scripts, PHP scripts, and other executable programs. Due to the higher resource consumption of these scripts compared to standard HTML pages, certain limitations must be enforced. We may not always identify which script or application is causing resource overloads; however, we can usually identify the account responsible. The following rules apply to all "active content" files:

  • Resource Consumption: Scripts must use minimal system resources. Any script that significantly consumes RAM or processing power will be suspended immediately until the owner is notified and an alternative solution is found.
  • Resource Limits: No user account may use more than 20% of system resources at any given time. If an account consistently uses 20% or more of system resources, the account holder will be notified, and failure to take corrective action may result in suspension.
  • Compatibility: There is no guarantee that scripts will function correctly with any server setup or hardware. Accounts running incompatible scripts may be terminated without warning and without a refund.
  • Reference Restrictions: Scripts cannot be referenced or used on any site not hosted by Gio Host.
  • Execution Time: Scripts must execute promptly. Any script that takes longer than a few milliseconds on the processor will be removed.
  • Malicious Content: Any script designed to attack or maliciously affect the server is strictly prohibited. If such scripts are discovered in your account, your account will be terminated immediately, and actions will be reported to local, state, and federal authorities for legal prosecution.
  • Prohibited Scripts: Chat room scripts written in Perl are strictly forbidden. Only high-end accounts may run bandwidth-intensive scripts, such as non-Perl chat room scripts or banner rotation scripts.
  • Script Security: All scripts must be kept secure. This includes avoiding unnecessarily setting permissions to 777 and not storing scripts in publicly accessible directories (those without an index.html file).
  • Account Security: You are entirely responsible for the security of your website's scripts. Gio Host will not be liable for any losses incurred due to script leaks or backdoors.

Note: If a script requires permissions other than 777 to run (which is uncommon), you may contact customer service for approval, which is typically granted. Accounts with scripts that violate these policies will have their CGI, Perl, CFM, ASP, and PHP scripts reviewed by our System Administrators. If a script is deemed harmful to the system, it will be terminated immediately, and the account will be locked until the account owner is informed. Accounts found with malicious scripts will be terminated immediately without reimbursement of any prepaid fees.

Resource Usage Policy
(a) Server Resource Abuse Policy (SRAP)

Any website on our shared servers that consumes excessive server resources (CPU, memory, and network bandwidth) will be given the opportunity to upgrade to a dedicated server. Abuse and misappropriation of system resources is a significant issue that Gio Host will not tolerate. Since accounts on a shared server must share resources with other users, we must limit how much CPU and RAM each account can utilize. It is unfair to allow one or two clients to consume all system resources on a shared machine, causing issues for all other customers. Excessive CPU and memory utilization by one or more clients can lead to sluggish performance across various services, including MySQL, Email, HTTP, and others. If CPU and memory consumption becomes excessive, all sites hosted on the server may experience problems and become inaccessible.

Limits on Server Resources:

  • Memory usage per account, file, or application cannot exceed 10%.
  • CPU usage varies by shared hosting plan; details can be found on the plan details page.
  • The number of Apache connections is limited to 30.
  • A maximum of 15 MySQL user connections per domain is permitted.
  • Email sending is limited to 250 emails per hour.
  • Stand-alone, unattended server-side processes are not allowed on shared servers; this includes all daemons, such as IRCD.
  • Running any form of web spider or indexer (including Google Cash / AdSpy) is prohibited.
  • Software that connects to an IRC (Internet Relay Chat) network is not allowed.
  • Running any BitTorrent client, tracker, or application is forbidden. You may link to legal torrents hosted elsewhere but cannot host or store them on our shared servers.
  • Participation in any file-sharing or peer-to-peer activities is not permitted.
  • Game servers (e.g., Counter-Strike, Half-Life, Battlefield 1942) are not allowed.
  • Cron jobs must run at intervals greater than 15 minutes.
(b) Illegal Usage

Gio Host servers are intended for legal purposes only. Any information, data, or material that is sent, stored, or distributed in violation of applicable laws or regulations is strictly prohibited. This includes copyrighted information, trademarks, trade secrets, and other intellectual property rights used without permission, as well as anything obscene, libelous, poses an illegal threat, or violates export control rules. Examples of unacceptable content include pirated software, hacker programs or archives, warez sites, MP3 files, and IRC bots. Any forum or discussion board that discusses how to obtain such files or distribute them is also illegal. The Gio Host service subscriber agrees to indemnify and hold Gio Host harmless from any claims arising from the subscriber's use of the service. Gio Host will be the sole adjudicator of what constitutes a violation of this condition.

(c) Illegal Content

Gio Host does not allow background daemons such as IRC bots; Eggdrop; BitchX; XiRCON; and any other programs that interfere with normal server operation. The use of warez is strictly prohibited. Web proxies are not permitted; examples include NPH-Proxy and other web proxies. If any proxy files are discovered on your site, your account will be suspended, and the account holder will incur a USD 50 fee. You are not permitted to run any servers or services on the Gio Host network while using a shell account. Examples of prohibited services include Perlbots, proxies, BitchX, psyBnc, root exploits, DDoS programs, Shoutcast servers, and similar applications. Running any of these will result in immediate suspension and a fine ranging from USD 50 to USD 100 for users. Gio Host reserves the right to terminate accounts for these violations.

(d) Software Distribution

Software and multimedia items are not permitted to be distributed using Gio Host web hosting accounts. Please contact our sales department for specific arrangements if you wish to distribute software and/or multimedia materials.

(e) Liabilities

Gio Host makes no representations or warranties regarding the services provided by our clients and will not be held liable for any disputes or claims brought against them. Gio Host will not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages resulting from the use or performance of this website or any information, services, or goods offered via your website. We are not liable for any content on our network's servers and will take action against dubious material only when it is brought to our attention via email.

(f) IP Address Ownership

All IP numbers and addresses assigned by Gio Host remain under our control. We reserve the right to change or remove any of these IP numbers or addresses at any time.

(g) Security

Users are prohibited from violating or attempting to violate the security of the Gio Host Network. Violations of system or network security may result in legal action. Gio Host will investigate incidents that may involve working with law enforcement authorities to prosecute violators. These violations include but are not limited to:

  • Accessing material not intended for the user or connecting to a server/account without authorization.
  • Attempting to probe, scan, or test a system's vulnerabilities without proper authorization.
  • Disrupting service to any user, host, or network through methods such as overloading or ping flooding.
  • Forging TCP/IP packet headers in any email or forum posting.
  • Taking actions to gain unauthorized services.

Users may not combine multiple hosting packages to take advantage of large amounts of space or bandwidth. Each hosting package paid for is exclusive to a single main domain; mixing bandwidth and space by purchasing multiple plans is prohibited and may be labeled misleading by Gio Host. All services have an upgrade path available; if users request assistance with upgrades, we can often work out special arrangements.

Violations of system or network security are strictly forbidden and may result in criminal and civil penalties. Examples include accessing unauthorized systems/data/traffic without permission; mail bombing; flooding; attempts to overload systems; forging packet headers; etc.

Server Abuse Policy

Any attempt to damage or harm a Gio Host server or a Gio Host subscriber is strictly prohibited, including but not limited to the following actions:

  • Unauthorized Access: Logging into a server or account that you do not have permission to use.
  • Service Misappropriation: Obtaining services not intended for you by accessing data or taking any unauthorized action
  • Vulnerability Testing: Attempting to probe, scan, or test any system, subsystem, or network for vulnerabilities without proper authorization.
  • Tampering and Hacking: Tampering, hacking, changing, or otherwise damaging or compromising security or authentication measures without sufficient authorization.
  • Malicious Transmission: Transmitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or other harmful programming routines designed to damage, disrupt, or degrade the functionality of a computer or the system.
  • Interference: Interfering with, intercepting, or taking control of any system, data, or information.
  • Service Disruption: Interfering with any user's, host's, or network's service through methods such as overloading, flooding, mail bombing, or crashing any computer system.

You shall be held liable for all actions taken on your account, whether they were carried out by you or others. The above policies apply to all Gio Host sub-networks and dedicated servers.

Bandwidth and Traffic Measurement Policy, and Overage Policy

Incoming and outgoing traffic allowances are included in all monthly traffic listings for Startup, Enterprise, Corporate, VPS, Dedicated Servers, and any other hosting plans at Gio Host. Incoming and outgoing traffic allowances are based on a 50/50 split of incoming to outgoing traffic based on the total assigned traffic; therefore, each is half of the total listed traffic. Any traffic usage exceeding the incoming or outgoing traffic totals will incur charges at the rate specified in your plan for overages per MB/GB.

The Gio Host traffic usage policy is straightforward: Each month, you are allocated a certain amount of traffic to use as you see fit. If your data transfer exceeds your plan's subscription limits for shared hosting plans, your account may be suspended. However, you may receive warnings via email, and our staff may contact you regarding overuse and provide positive options. Gio Host does not guarantee any minimum bandwidth for shared bandwidth ports (which is typically offered with VPS/Dedicated Server/FTP server plans). However, users can opt for dedicated bandwidth ports, which come with a 75% bandwidth guarantee up to the upstream service provider's servers in Singapore or the UK. Dedicated bandwidth ports are available as an add-on; please contact Gio Host's sales team for pricing.

Scheduled Maintenance and Downtime

Gio Host will provide services 24 hours a day, seven days a week, using commercially reasonable efforts. Subscribers acknowledge that services may be unavailable or inoperable from time to time for various reasons, including scheduled maintenance or upgrades (“Scheduled Downtime”), service malfunctions, and causes beyond Gio Host's control or that are not reasonably foreseeable, such as telecommunications or digital transmission outages. Scheduled Downtimes will be communicated to subscribers at least 48 hours in advance, and Gio Host will take commercially reasonable steps to minimize any additional disruption or inaccessibility of its web servers. Gio Host is not liable for any downtime caused by a user's actions. Additionally, shared accounts are not covered by the 99.99% network uptime guarantee.

Responsibilities of Clients with Gio Host
Accountability for Activity

Clients are responsible for all activities originating from their accounts unless proven to be victims of hacking or address forgery. This includes maintaining the security of their username and password. Clients must also take responsibility for any third-party content on their websites, such as links to Free For All pages. Understanding basic internet languages, protocols, and software is essential, depending on the client's intended use of their web space. For example:

  • Web Publishing: Requires knowledge of HTML, document location, linking, FTP for uploading web content, and handling various media types like graphics and sound.
  • FrontPage Tools: Familiarity with FrontPage tools necessitates understanding Telnet and FTP.
  • CGI Scripts: Clients should be knowledgeable about the UNIX environment, including commands like TAR and GUNZIP, Perl scripting, and permissions.
  • Email Management: Clients need to be adept at using mail clients for sending and receiving emails.

Clients affirm they possess the necessary skills to design and maintain their websites and acknowledge that Gio Host is not responsible for providing this knowledge or support outside of server-related issues.

Data Backups Policy for Gio Host

Gio Host emphasizes the importance of data security but disclaims any responsibility for data loss under any circumstances, particularly for shared hosting accounts. Clients are strongly advised to back up all important data on their local devices regularly. Important data should be stored in multiple locations to ensure maximum security.

Gio Host provides an automated remote backup option for shared web hosting users, which is performed once a week. However, this backup service is limited to the last backup only and does not guarantee recovery from all types of data loss. It is essential for clients to understand that Gio Host is not responsible for any disasters that may occur affecting shared hosting data.

For accounts exceeding 50 GB, no automated backup service is available. Additionally, no backup solutions are provided by default for VPS or dedicated server users; clients must establish their own backup strategies. Third-party backup solutions can be arranged at additional costs based on vendor terms.

Clients are encouraged to maintain their own backups regularly and ensure that critical data is safeguarded independently of the services provided by Gio Host.

Account Management and Violations

Failure to comply with these terms may result in account deactivation. Gio Host retains sole discretion over what constitutes a violation of its Acceptable Use Policy (AUP) and reserves the right to suspend or terminate accounts at any time. If a violation is suspected, Gio Host may investigate and temporarily block access to prevent further potential misconduct. Depending on the severity of the violation, actions may include account suspension or termination, alongside possible legal action if criminal activities are involved.

Gio Host does not offer refunds for downtime caused by service interruptions due to AUP violations. Clients agree to indemnify Gio Host against any claims arising from their use or misuse of services. Services are provided "as is," without warranties of any kind, including merchantability or fitness for a particular purpose. No guarantees are made regarding the availability or error-free operation of services, and clients should not rely on any oral or written information as a guarantee.

This comprehensive framework ensures that clients understand their responsibilities while using Gio Host services and highlights the importance of maintaining security and compliance with established policies.

Modification of Terms

Gio Host reserves the right to modify, add, or delete any provisions of this policy at any time without prior notice. Clients are encouraged to review these terms periodically to remain informed of any changes.

Refusal of Service

Gio Host maintains the sole discretion to refuse, cancel, or suspend services at any time. This may occur if an account repeatedly violates our policies after receiving warnings. Common reasons for refusal of service include spam or script abuse. Additionally, if a customer exhibits unreasonable or unprofessional behavior, becomes excessively difficult to work with, or threatens staff, Gio Host may suspend their account and recommend they seek a different hosting provider.

In cases where a server becomes unstable and an account is identified as the source of the issue, Gio Host reserves the right to suspend that account to maintain overall server functionality. If a customer's resource usage increases significantly, we may suggest upgrading their service plan accordingly.

General Terms

All services provided by Gio Host are subject to interpretation and change at the discretion of our administrators without prior notice. Charges are nonrefundable and non-negotiable, except for our 7-day money-back guarantee. Any breach of these Terms of Service will result in account termination. Gio Host reserves the right to terminate accounts at any time without notice. Additionally, we may delete accounts with 15 days' notice if deemed necessary.
